1. General Agreement
When using our services, you agree to adhere to these Terms of Service. These terms apply to all clients, including businesses, organizations, and individuals, who contract us for website design, hosting, or related services.
2. Services Provided
We specialize in:
- Custom WordPress website design
- Website Hosting
- Maintenance and Updates
- Integration with third-party tools or plugins
- Local SEO
- Google Business Profile Management
We will provide these services as outlined in the agreement or contract for your project.
3. Billing and Payments
Monthly Hosting Fees: All hosting services are billed monthly in advance. Payments are non-refundable once billed.
Design and Development Fees: Design and development fees are charged according to the terms outlined in your agreement.
Late Payments: Accounts past due by more than 10 days may suspend service until payment is received.
4. No Refund Policy
Hosting and maintenance fees are non-refundable.
Refunds for project deposits are not provided once work has begun.
5. Cancellation Policy
Clients may cancel hosting services by providing a 30-day written notice. Upon cancellation:
- Clients must ensure their website is transitioned to a new provider within the notice period.
- After terminating our services, you must secure licenses for any premium themes or plugins on your website.
6. Website Ownership and Licensing
The website’s design and content become the client’s property upon full payment of project fees.
Premium themes, plugins, or other third-party tools provided through our licenses must be replaced or re-licensed upon termination of services.
Failure to transition away from our licensed themes or tools may result in deactivation.
7. Content and Responsibility
Clients are responsible for providing accurate, lawful, and copyright-compliant content for their website.
We reserve the right to refuse to host or design inappropriate, illegal, or harmful content.
8. Service Limitations and Downtime
While we strive for 99.9% uptime, occasional interruptions for maintenance or technical issues may occur.
We are not responsible for downtime caused by third-party providers or unforeseen events (e.g., natural disasters, cyberattacks).
9. Client Responsibilities
Clients are responsible for:
- Keeping their billing and contact information up to date.
- Ensuring the transition of their website and related assets upon cancellation.
- Backing up their website data.
10. Indemnification
Clients agree to indemnify and hold us harmless from any claims, damages, or losses resulting from their use of our services, including but not limited to legal actions related to website content or operations.
11. Privacy Policy
We value your privacy. Our privacy policy details how we collect, use, and protect your data.
12. Termination of Services
We reserve the right to terminate services if clients violate these terms or engage in activities that compromise our operations, reputation, or legal standing.
13. Governing Law
The laws of the State of Minnesota govern these Terms of Service. Any disputes will be resolved under Minnesota state law.
14. Changes to Terms
We reserve the right to update these Terms of Service at any time. Clients will be notified of significant changes via email or website notice.
